The UAE has tightened two separate but connected compliance points in 2026: work permit issuance is now gated on Wage Protection System (WPS) status, and the Golden Visa's Executive category has a new minimum tenure requirement — changes that raise the operational bar for employers well beyond visa paperwork.

What Has Changed

MOHRE now checks WPS compliance in real time at the point a work permit application is submitted. Employers with outstanding wage arrears or WPS non-compliance cannot issue new work permits until the arrears are cleared — payroll compliance and immigration compliance are now directly linked at the system level, not just in principle.

The 2026 employment visa changes also raise the minimum salary band for Skill Level 1 workers and introduce a 90-day grace period after termination during which an employee can transfer sponsorship or exit the country, replacing shorter or less clearly defined windows.

Separately, Golden Visa Executive category applicants must now complete at least two years of continuous employment with their current UAE employer before submitting an application — a tenure requirement that didn't previously apply in the same form. Educational document requirements have also tightened: for a Managerial job title application, a legalised certificate must clearly show a Bachelor's or Master's degree from a university; certificates from institutions identified as diploma-issuing do not qualify for Managerial classification. Golden Visa holders who take a new job still need their new employer to issue a MOHRE work permit — typically around five working days under the u.ae Work Bundle initiative — the Golden Visa itself does not exempt them from this step.

The WPS linkage means a single payroll compliance lapse can now block new hiring entirely, not just create downstream liability. Employers need WPS status verified as a precondition for any new UAE work permit application, not as a parallel HR process.

The Golden Visa Executive tenure rule affects succession and retention planning — an executive being considered for Golden Visa sponsorship needs their UAE employment history checked against the two-year threshold before the application is initiated, and the degree-certificate rule means credential verification needs to happen before, not during, a Managerial-title application.
